Online Content is for Access or Use by US Residents Only

Please be aware that Campaignium does not offer goods or services to non-residents of the United States of America (the “USA”), and the Online Content is only intended for use by residents of the USA. If you are not a resident of the USA, you are not permitted to use the Online Content and must stop immediately. We do not intend to monitor the behavior of any person located outside the USA, nor to profile any such person in order to take decisions concerning that person or analyzing or predicting that persons personal preferences, behaviors, or attitudes. By accessing or otherwise using the Online Content you represent and warrant to Campaignium that you are a resident of the USA.

Information Collected by Campaignium

We use this information to continually improve the convenience and functionality the Online Content.

Campaignium collects the information which is provided by you on registration (if you establish an account) such as name and email address, together with information we learn about you from your use of the Online Content, including, without limitation, your visits to our web site, your visits to other sites accessible from our web site, and any other use by you of the Online Content.

Disclosures of Your Information

Your information may be used by Campaignium, all of its related companies and affiliates. We will never pass your personal data to anyone else, except for any successors to our business and the organizations that process data on our behalf. As described below, the Online Content may include tags and other technologies that allow third parties to track your use of the Online Content. Their collection and use of such data is not considered a disclosure by Campaignium, and is subject to your agreement with any policies put in place by those third parties. We may also use and disclose information in the aggregate (so that no individual customers are identified) for marketing programs, advertisers, and partners.

Campaignium may display targeted advertisements to you through the Online Content based on personal information. Campaignium does not provide any individual personal information to the advertiser when you interact with or view a targeted ad. Advertisers (including ad serving companies) may, however, assume that people who interact with, view, or click targeted ads meet the targeting criteria—for example, women ages 18-24 from a particular geographic area.

We may transfer information about you if Campaignium is acquired by or merged with another company.

When you use some portions of the Online Content that are visible to the public, or post on a forum, chat room, or social networking service and tag or link to Campaignium, the personal information and content you share is visible to other users and can be read, collected, or used by them. You are responsible for the personal information you choose to share or submit in these instances. For example, if you list your name and email address in a forum posting, that information is public. Legal Disclaimer

We reserve the right to disclose your personally identifiable information as required by law and when we believe it is necessary to share information in order to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations of Campaignium terms of use, or as otherwise required by law.

Other Web Sites

The Online Content may contain links to other web sites which are outside of Campaignium’s control and are, therefore, not covered by this Privacy Policy. If you access other sites using the links provided, the operators of these sites may collect information from you which will be used by them in accordance with their privacy policy, which may differ from ours.

Cookies

“Cookies” are small pieces of information sent by a web server to a web browser, which enables the server to collect information from the browser. Campaignium uses cookies for a number of purposes, for instance to enable us to simplify the logging on process for registered users, to ensure the security and authenticity of registered users, and to enable traffic monitoring.

Campaignium may use both session ID cookies and persistent cookies. We use session cookies to make it easier for you to navigate our site. A session ID cookie expires when you close your browser. A persistent cookie remains on your hard drive for an extended period of time, unless you remove the cookie in the manner determined by your particular Internet browser. Disabling the cookie function for your Internet browser will restrict the online services you can use at the Campaignium website. By using the Online Content, you consent to the storage of both types of cookies, and any similar technologies developed in the future, on your device.

Web Beacons

We use clear gifs, pixel tags, and other similar technologies in the Online Content from Google Analytics, Google Remarketing, Facebook, and other 3rd party vendors. This enables us to gauge the effectiveness of our services and marketing programs. By using the Online Content, you consent to the use of these technologies, and any similar technologies developed in the future, to track your use of the Online Content.

Social Media

The Online Content may include social media features, such as the Facebook Like button, and widgets such as the “Share This” button or interactive mini-programs that run in the Online Content. These features may collect your Internet protocol address, which page you are visiting on our Website, and may set a cookie to enable the feature to function properly. Social media features and widgets are either hosted by a third party or hosted directly on our web site. Your interactions with these features are governed by the privacy statement of the company providing it.

Other Technologies

Campaignium may use other technologies, both currently existing and yet to be developed, to collect information from you and about your usage of the Online Content.  Campaignium is not limited to using only technologies that are disclosed in this policy, but may uses other such technologies as it determines are necessary or useful in its sole discretion.

As is true of most internet services, we may gather some information automatically and store it in log files. This information includes Internet Protocol (IP) addresses, browser type and language, Internet service provider (ISP), referring and exit websites and applications, operating system, date/time stamp, and clickstream data. We use this information to understand and analyze trends, to administer the site, to learn about user behavior on the site, to improve our product and services, and to gather demographic information about our user base as a whole. Campaignium and its affiliates may use this information in our marketing and advertising services.

In some of our email messages to you, we may use a “click-through URL” linked to content on the Campaignium website or other portions of the Online Content. When customers click one of these URLs, they may pass through a separate web server before arriving at the destination page on our website. We track this click-through data to help us determine interest in particular topics and measure the effectiveness of our customer communications. If you prefer not to be tracked in this way, you should not click text or graphic links in the email messages. By doing so you consent to such tracking by the third party websites.

Pixel tags enable us to send email messages in a format customers can read, and they tell us whether mail has been opened. We may use this information to reduce or eliminate messages sent to customers. By providing an email address to us, you consent to receiving emails containing such tags.

Do Not Track Notice

We do not track our web visitors across third party websites to provide targeted advertising and, therefore, our Website does not respond to Do Not Track (DNT) signals. We do not support Do Not Track browser settings and do not currently participate in any Do Not Track frameworks that would allow our Website to respond to signals or other mechanisms from you regarding the collection of your personal information.

Security

The security of your personal information is very important to us. Do not send sensitive information to Campaignium via e-mail. Campaignium does not currently accept sensitive personal information via the Online Content, but it may choose to do so in the future. If and when you provide sensitive information to Campaignium via the Online Content, we will encrypt that information for transmission using secure socket layer technology (SSL) or other common security protocols in use at that time. If we receive certain types of data from you, we may immediately re-encrypt selected portions of the data prior to storage. Campaignium does not currently accept payment information via the Online Content, but may do so in the future. By default, payment card data, if collected, will be permanently destroyed within 91 days of submission, though in some cases it may be retained longer at Campaignium’s discretion.

Campaignium follows generally accepted industry standards to protect the personal information submitted by you, both during transmission and upon receipt. No method of transmission over the Internet, or method of electronic storage, is 100% secure. Therefore, while Campaignium strives to use commercially acceptable means to protect your personal information, we cannot guarantee its absolute security. Any information you transfer to us is at your own risk.

If we learn of a security systems breach we may attempt to notify you electronically so that you can take appropriate protective steps. By using the Online Content or providing personally identifiable information to us you agree that we can communicate with you electronically regarding security, privacy and administrative issues relating to your use of the Online Content. We may post a notice on our web site if a security breach occurs. We may also send an email to you at the email address you have provided to us in these circumstances. Depending on where you live, you may have a legal right to receive notice of a security breach in writing.

Collecting Information from Minors

We do not intend to collect personal information from children who identify themselves as being under 18 years of age. Children should not provide personal information on the web site or any part of the Online Content, and should ask their parents to submit a request on their behalf if they want to receive information related to the Online Content. As per the Children’s Online Privacy Protection Act (15 U.S.C. 6501, et seq.), we do not knowingly collect or maintain personal information from persons under the age of 13.

Campaignium reserves the right to modify this privacy statement at any time, so please review it frequently. If we make material changes to this policy, we will notify you by posting the new policy here and no further notification shall be required.

Governing Law, Venue and Forum

Unless otherwise noted in this Privacy Policy, this Privacy Policy and Terms of Use shall be governed by the laws of the State of Missouri and by the federal laws of the United States, excluding their conflicts of laws provisions. All disputes, controversies and disagreements between the parties arising out of or related to this Privacy Policy shall be exclusively submitted for, resolved and finally settled by, binding arbitration. The arbitration shall be conducted by three (3) arbitrators exclusively in Greene County, Missouri, in accordance with the Commercial Arbitration Rules of the American Arbitration Association. The Parties waive any objection that might be made on the ground that such venue may be in an inconvenient forum.
